The Walgreens’ developers had appealed the zoning board’s ruling against them. The ruling stated that the commercial use of residentially zone land was not legal. It also agreed with the community in that Walgreens’ stated intentions to use the residential land for access to the drive-through and parking lot and deliveries did in fact constitute commercial use.

Today, a preliminary hearing was held in common pleas court. It was decided by the parties involved to postpone the hearing until the rezoning request before city council was resolved. This will save money for both parties as the case will only proceed if it remains relevant by city council voting to support the community and not grant the rezoning, or in the case where the community would win in a follow-up appeal planned by the community in the event that city council votes against the community’s interests.
